Terminix Hit with Class Action Over Alleged Spam Telemarketing Calls

Terminix International Company, L.P. faces a proposed class action filed by a consumer who claims the pest control outfit placed a series of unlawful automated calls to his cell phone, even after he requested that the calls stop.

The eight-page lawsuit out of Missouri alleges violations of the federal Telephone Consumer Protection Act, which prohibits companies from placing non-emergency calls by way of an automated dialing system without the recipient’s express written consent.

The plaintiff says he contacted Terminix around May 5, 2020 to inquire about the company’s services and request a quote. After he informed the Terminix representative that he was not interested in the company’s services, the man began receiving calls from Terminix to his cell phone, the case claims. Per the complaint, the calls were placed from an array of phone numbers, including (417) 841-5459.

Each call began with a pre-recorded greeting prompting the plaintiff to press certain keys in order to speak with a live representative, the complaint relays. Though the plaintiff requested that Terminix stop calling due to the frequency of the calls, the defendant “willfully ignored” his demand and called him at least 23 more times after receiving his request, the lawsuit says.

In addition to the calls, the plaintiff has also received at least one email marketing Terminix’s services, “in spite of [the plaintiff’s] lack of interest.”

According to the suit, the plaintiff and proposed class members have been “unfairly and unnecessarily harassed” by Terminix’s telemarketing conduct.
